We will explore the new rules and realities for newspapers
that operate digital news platforms. The way that content is
exploding across digital news sites on a moment’s notice—from instant reporting to instant feedback and a treasure trove
of audio, video and photographic source material—means
more possible plaintiffs and more creative claims against
newspapers.
It is critical for newspapers to understand how their digital
news operations can invite new and different forms of legal
scrutiny so that newspapers can develop more effective
means to protect themselves.
John Bussian has represented the
media on a national level in the
courts and political arena for 30 years. He regularlylitigates First
Amendment matters, including
libel and invasion of
privacy lawsuits against media interests. He also
handles cases for the media to preserve distribution
rights, protect copyrights, secure access to government
records and protect against subpoenas and other
attempts to force disclosure of users posting material to
websites. Bussian
chairs the Southern Newspaper
Publishers Association’s First Amendment Committee.
Charles Marshall advises media
companies and trade associations
on digital media issues, including
defamation, right of publicity,
copyright, and related newsgathering
issues. He served as outside
counsel to the McCain-Palin presidential
campaign on media law issues, where he worked on trademark, copyright and privacy
issues. He regularly appears before state
and federal courts and has special experience
in appellate advocacy from his prior
work at the United States Department of
Justice.
